arrest and release
On May 26, 2020, the officers involved in the arrest and encounter of George Floyd were put on leave. All four officers (Derek Michael Chauvin, Tou Thao, Thomas K. Lane and J. Alexander Kueng) were fired later in the day. On the same day, the FBI announced a review of the incident.
On May 28, 2020, the U.S. Department of Justice and the FBI issued a joint statement making the investigation into Floyd’s death a “top priority.” They said in a statement,
A full investigation will compile all available information and thoroughly evaluate the evidence and information obtained from witnesses…and if a violation of federal law is determined, criminal charges will be pursued. “
On May 29, 2020, Derek Chauvin became the first white police officer in Minnesota to be arrested for the death of a black civilian. Chauvin was charged with third-degree murder and second-degree manslaughter. Thao was arrested on June 3, 2020. Tou Thao was charged with aiding and abetting second-degree murder without intent and aiding and abetting second-degree manslaughter with negligence causing an unreasonable risk. All four (Derek Michael Chauvin, Tou Thao, Thomas K. Lane and J. Alexander Kueng) appeared in court on June 29.
Hennepin County District Judge Peter A. Cahill set the next hearing for September 11, 2020, with a trial date of March 8, 2021. On July 4, 2020, Tou Thao was released from Hennepin County Jail on “Bail and Conditional.” Tou Thao’s bail is $1 million unconditional or $750,000 conditional. With the release of Tou Thao, three of the four former Minneapolis police officers who faced charges in the fatal encounter with George Floyd have been released. Only Derek Chauvin remains behind bars on $1.25 million bail.
