In August 2021, the academy, led by CJI NV Ramana, took a major decision by recommending the names of three women to appoint justices to the Supreme Court of India, including Justice BV Nagarathna. This is a historic decision as BV Nagarathna is likely to be head of the judiciary in 2027, which will make her India’s first female chief justice. On August 31, 2021, BV Nagarathna was sworn in with eight other judges in the Supreme Court of India. She was nominated for the position by NV Ramana and appointed by Ram Nath Kovind.
For the first time in Indian history, nine new Supreme Court justices took the oath in one sitting. With three women presiding over the oath of office, Justices BV Nagarathna, Justice Bela M Trivedi and Justice Hima Kohli, the Supreme Court was given four incumbent female justices, beating the previous record of three incumbent female justices. Following her appointment as a Supreme Court Justice, she was invited as the chief guest at the inauguration of the Child Care Centre at the Civil Court Complex in Bengaluru. The nursery facility was created to benefit the children of lawyers and court staff. Nagarathna approved the first such facility in the courthouse while serving as an administrative judge at the Bengaluru Civil Court.
Notable Verdicts:
- Noting the rise of sensationalist news, in 2012 Nagarathna ordered the federal government to consider the possibility of regulating Indian broadcast media through a statutory framework.
- Sri Jagadev Biradar v Karnataka (2016): A panel of BV Nagarathna judges dismissed the Karnataka government’s appeal challenging the repeal of the Motor Vehicle Tax (Amendment) Act 2014 “Judgment. The court held that the state government cannot compel owners of non-Karnataka vehicles to pay lifetime taxes for using their vehicles in Karnataka for more than 30 days on the grounds that the state’s law violates Section 246(3) . However, the order reiterates that owners of non-Karnataka vehicles must re-register their vehicles in Karnataka and pay the necessary lifetime tax if they have been in the state for more than 12 months.
- Indian Tobacco Institute and Union of India (2017): Karnataka High Court reverses 2014 amendment rule requiring pictorial health warnings to cover 85% of tobacco product packaging on the grounds that they violate constitutional norms . Previously, the warning rule was notified by the Union Ministry of Health. A Chamber of BV Nagarathna held that the Federal Ministry of Health did not have jurisdiction to make such amendments. However, the court announced that the 40% picture health warning rule that existed before the revised rule would remain in effect.
- Sri Mookambika Temple v Mr Raviraja Shetty (2018): A three-judge panel led by Justice BV Nagarathna held that a temple was not a place of business; therefore, its employees were not entitled to remuneration under the Payment of Remuneration Act 1972 (PG) Act . The judge made this observation under the Karnataka Stores and Commercial Establishments Act 1961 (KS&CE), which excludes Hindu religious establishments.
- In 2020, the Karnataka High Court upheld the state government’s decision directing state and private universities to adopt a unified approach to promoting mid-term students in undergraduate and postgraduate programmes. This policy was introduced to ensure that any difficulties to future career development for students due to the different approaches adopted by the University are removed.
- In 2021, a division led by Justice BV Nagarathna overturned a notice issued by Karnataka Power Transmission Company Limited (KPTCL) which mentioned that if an employee’s second wife or her children marry during the marriage , you are not eligible for compassionate grounds appointments. In 2009, BV Nagarathna, Karnataka High Court Chief Justice PD Dinakaran and a senior judge were detained by a group of protest lawyers at the Karnataka High Court. Advocates were angry because they noticed that despite calls to boycott all lawsuits in courts across the state, Dinakaran was still at the hearing. While handling the case against PD Dinakaran, the Bengaluru-based Advocate Association announced a boycott of the Karnataka state court due to allegations of corruption, asset accumulation and serious irregularities. Nagarathna was reportedly treated roughly; meanwhile, Dinakaran was thrown at him by a sharp object, causing injuries. Addressing the public after the incident, Nagarathna said,
We can’t be intimidated just like that. We have sworn the constitution”
