Arrest and Sentencing
On June 11, 1991, the Central Bureau of Investigation (CBI) arrested Perarivalan at the residence of Periyar Thidal, Chennai, to investigate Rajiv Gandhi’s assassination.Later, proceedings were brought under the Terrorism and Disruptive Activities (Prevention) Act [TADA] In response to Perarivalan’s alleged role in the assassination, he is accused of purchasing and supplying the 9-volt battery for the explosive device to Sivarasan, the mastermind of the assassination. On January 28, 1998, a special TADA court in Chennai announced the death sentence for all 26 defendants, including AG Perarivalan. The Perarivalan case was convicted of conspiracy (IPC 120-B) and murder (IPC 320). On May 11, 1999, the Supreme Court of India sentenced AG Perarivalan to death. On February 18, 2014, Chief Justice of India P Sathasivam and Justices Ranjan Gogoi and Shiva Kirti Singh commuted the death sentences of Perarivalan and two other offenders, Murugan and Santhan, to life imprisonment. He has since been held at the Purzal Central Prison in Chennai.
Big revelation 26 years later
Perarivalan’s story has some twists and turns. It is also believed that AG Perarivalan was the victim of a flawed investigation. Twenty-six years after his arrest, the case has progressed significantly. On October 27, 2017, former CBI officer V. Thiagarajan filed an affidavit with the Supreme Court of India alleging that he was the one who recorded Perarivalan’s confession during the 1991 investigation. He further stated that he omitted part of Perarivalan’s confession in which he admitted that he did not know that the batteries he purchased and handed to the mastermind, Sivarasan, would be used in improvised explosive devices that would kill Rajiv Gandhi. He also cited a radio message dated May 7, 1991, sent by key conspirator Sivarasan to a senior LTTE agent, Pottu Amman. In the message, Sivarasan can be heard saying, “Our intentions are unknown except for the three of us” – himself, Subha and Dhanu (suicide bomber). It is possible that Perarivalan was not involved in the conspiracy. However, in 2018, the CBI refuted former CBI interrogator V. Thiagarajan’s claim that he deliberately omitted parts of Perarivalan’s confession. The CBI report further stated that Perarivaran was deeply involved in the plot to assassinate Rajiv Gandhi.
